This document constitutes the rules jointly referred to as the Anti-Spam Policy applied by iPresso S.A. with its registered office in Katowice (40-514), at ul. Ceglana 4, (hereinafter: "iPresso") regarding sending unsolicited commercial information. iPresso has a zero tolerance policy with regard to sending such messages. By creating an account in the iPresso service (hereinafter referred to as the "Service"), as a user of this Service ("User") and using the Service, you agree to the following rules and agree to use the Service in accordance with the iPresso Anti-Spam Policy, the content of which is described in this document.
Notwithstanding the obligation to comply with the provisions of this Policy, Users must comply with all legal requirements provided for electronic service providers in the country of residence of the User and his Contacts and to the provisions of the following legal acts (in the applicable version):
Spam is undesirable and unsolicited commercial information, sent electronically, usually sent massively to many recipients at the same time. The term "unsolicited" means that the recipient has not given prior intended consent to receive this type of message. The term "spam" refers to the transmission, distribution or delivery, particularly of bulk, unsolicited commercial information by electronic means. Spam is also unsolicited mass messages sent via e-mail or SMS to recipients, whose addresses come from databases created unlawfully or contrary to good e-mail marketing practices.
The user is fully responsible for the lawfulness of sending all messages to the particular recipient. The user is obliged to obtain all necessary, prior and verifiable consents in this regard, as well as to consolidate them. The recipient's consent must be clear and unambiguous, it may not be in any way presumed or derived from a statement or statement of a different content. Additionally, the recipient must be entitled to easily revoke consent at any time. It is forbidden to send messages to recipients who have withdrawn their consent to receive them. iPresso SA is not responsible for the content, correctness and the manner of obtaining the consent referred to in this section.
It is forbidden to send messages to people who have not consented to receive them. It is allowed to store and manage data and send electronic information only to those who have gave consent to receive it.
As part of the Service, iPresso SA will send each new subscriber a message confirming his interest in receiving messages. Users can ask for this confirmation to be deactivated when saving via email and form.
As part of the iPresso SA Service, Users are strictly forbidden to borrow and purchase email addresses from third parties. It is also forbidden to obtain addresses through any covert actions, such as scraping or harvesting. It is forbidden to use any kind of automated solutions, software or scripts that enable the collection of contact data.
We reserve the right to verify the list of subscribers imported by the User in terms of having the required consents for sending e-mails, correctness and validity of e-mail addresses, the presence of spam-traps or errors in e-mail addresses. A negative verification result entitles us to reject the imported list.
The subject or designation of the message sender must not be misleading as to the intention and content of the message. The User is obliged to indicate truthful and accurate information about the sender and the subject in the Message. Messages cannot contain illegal, inciting to commit illegal, discriminatory, offensive or vulgar acts. It is strictly forbidden to send SPAM or Phishing messages via the iPresso SA Application.
In the case of advertising content, the message should clearly indicate that its main purpose is advertising.
The user is solely responsible for the content of the messages sent. iPresso SA is not responsible for the content sent by the User when using the Service.
Messages sent to Contacts via the iPresso Application should contain a link enabling you to unsubscribe from the mailing list. The link automatically updates the mailing list so that the subscriber who clicked on the link to unsubscribe will no longer receive any messages from that source. It is forbidden to remove, hide or modify the link, as well as charge fees or request other than email address information identifying a person who wants to unsubscribe from the mailing list.
In accordance with this Antispam Policy, it is also forbidden to send messages to people who were added to the list of subscribers in the past and then unsubscribed from it.
Using the Service to send Spam messages is strictly prohibited.
If the User sends out Spam or otherwise uses the Service unlawfully or in the Regulations for the provision of services, iPresso will take appropriate steps, such as immediate deactivation of the account without the possibility of a refund, and notification of the User's practices to its internet provider or relevant authorities. Taking the indicated steps does not have to be informed about such intention by the User.
In addition, in the event that iPresso SA would incur any liability (civil, administrative, criminal, other) resulting from the User's breach of the obligations set out in this Policy - the User is liable to iPresso on a recourse basis for any damage, including lost profits arising from For this reason.
The User is also responsible for damages incurred by iPresso and third parties in connection with the User's failure to comply with the Anti-Spam Policy.

The owner of the iPresso system - iPresso SA reserves the right to introduce changes to the Antispam Policy, related to, inter alia, changes in regulations. The user will be informed of any modifications to the anti-spam policy by publishing it on this page and providing information about changes in the newsletter or by e-mail.
